It is rather simple for children of U.S. citizens over 21, they become immediate relatives and can adjust as long as they have remained single. For children of Permanent Residents the process is similar, but they still must wait in the 2A preference category. posted by Daniel | 7:36 AM Wednesday, November 20, 2002 LABOR CERTIFICATION/PERMANENT RESIDENCY THROUGH EMPLOYMENT The Labor Certification process allows a U.S. employer to sponsor a foreign worker upon a showing that the foreign worker will not displace or adversely affect a United States worker in the same field. The process is three part. First an application must be filed with the appropriate state Department of Labor. After certification, the application is used to apply for a visa from the Immigration and Naturalization Service. Only after this has been approved can an alien Adjust Status to that of a Lawful Permanent Resident. The process can take as little as 18 months or as long as 3 years depending upon the backlog at the local Department of Labor. posted by Daniel | 9:01 AM |
